Terms of Service
These Terms of Service ("Terms") govern your use of visaphotofit.com and the VisaPhotoFit photo tool (the "Service"). By using the Service you agree to these Terms. If you do not agree, please do not use it.
1. What the Service does
VisaPhotoFit is an independent online tool that helps you crop, resize and compress a photo (and, for document types where it is appropriate, straighten it or replace its background) so that it follows the published technical requirements for United States visa, passport and immigration photos. It works inside your web browser. VisaPhotoFit also offers online PDF tools (editor and signer, compressor and merger) that work on your files in your browser, and a photo tool for children and pets.
2. We are not a government agency
VisaPhotoFit is not affiliated with, endorsed by, or connected to the U.S. Department of State, U.S. Citizenship and Immigration Services (USCIS), the Department of Homeland Security, or any other government body. We do not file applications, submit photos on your behalf, or provide legal or immigration advice. Nothing on the Service is legal advice. For legal questions, consult a licensed attorney or accredited representative.
2A. Electronic signatures
Signatures made with the PDF tool are simple electronic signatures (an image of a signature placed on a document). They are not certified digital signatures and do not include identity verification. Whether an electronic signature is valid or accepted depends on the document, the law and the person or office receiving it, and some documents have special rules. Check with the recipient and, if needed, a lawyer. We do not provide legal advice.
3. No guarantee of acceptance
Government agencies set photo requirements and may change them at any time. The final decision on whether a photo is acceptable belongs to the agency or the consulate reviewing your application. We work hard to keep the Service aligned with the published rules, but we cannot guarantee that any photo created with the Service will be accepted. You are responsible for checking the requirements on the official website (such as travel.state.gov and uscis.gov) before you submit.
4. Your photo and your responsibilities
- You may upload only photos that you own or have permission to use, including permission from the person pictured (or a parent or legal guardian for a minor).
- You confirm that the photo shows the applicant as they look now, was taken within the required time period, and has not been altered to change the applicant's appearance. Our background replacement does not retouch faces, but you must not use the Service to misrepresent a person's identity or to create fraudulent documents.
- You are responsible for details the Service cannot check, such as glasses, head coverings, expression and how recent the photo is.
5. Acceptable use
You agree not to misuse the Service. For example, you will not attempt to disrupt or overload it, probe or bypass its technical protections, scrape it at scale, reverse engineer it except where the law allows, or use it for any unlawful purpose, including identity fraud.
6. Fees, payments and refunds
The Service may be free or may charge a fee for downloads. Any price is shown before you pay. Payments are handled by our payment provider (currently our payment provider); we do not see or store your card details. Fees are for a digital product that is delivered immediately in your browser.
If you paid and the file you downloaded does not match the technical specifications we list for the document type you chose (for example, the pixel size or file-size limit), contact us at support@visaphotofit.com within 30 days and we will fix the problem or refund you. Because acceptance is decided by the government and depends on factors outside our control (see Section 3), we do not refund solely because an agency or consulate rejected a photo that met our listed specifications. Nothing in this section limits rights you have under applicable law.
7. Intellectual property
The Service, including its design, text, code and branding, belongs to VisaPhotoFit or its licensors and is protected by law. You keep all rights in your photos. We do not claim any ownership of your photos, and we do not receive them (see our Privacy Policy). The Service uses open-source software and models under their own licenses.
8. Third-party services
The Service may link to third-party websites, including government websites. We are not responsible for third-party content or availability.
9. Availability and changes
We may change, suspend or discontinue any part of the Service at any time. We may also update these Terms. When we do, we will change the "Last updated" date above. If you keep using the Service after changes take effect, you accept the updated Terms.
10. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Automated checks (for example face, focus, lighting and background detection) are estimates and can be wrong.
11. Limitation of liability
To the maximum extent permitted by law, VisaPhotoFit and its owners, contractors and affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities, travel or application costs, or application delays or denials, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim, or US$50 if you paid nothing. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.
12. Indemnity
You agree to defend and indemnify VisaPhotoFit against claims, damages and expenses (including reasonable legal fees) arising from your breach of these Terms or from photos you upload without the right to do so.
13. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. If you are a consumer, this does not take away any mandatory consumer rights you have under the laws of the place where you live. Before filing a claim, you agree to contact us at support@visaphotofit.com and try to resolve the issue informally for at least 30 days.
